1. Hereditas Antiquarium as an Auction House organises, handles and conducts the auction on behalf of the vendors and acts as a commercial agent.
2. The online auction is not linked to any traditional auction event. One can bid on the lots via the online interface of the www.axoiart.hu auction portal, where buyers indicate their wish to bid during the published time period, using the bid/bid agent function, which becomes available after registering and logging in on the website of the service provider. Upon the conclusion of the first lot, the auction will be accessible from the archive of the service provider.
3.The lots called up are presented in succession as in the catalogue from 5:00 PM (CEST) with 30-second differences. If there is a bid for a given lot in the last 45 seconds, its expiration time is extended by 45 seconds. The auction lasts until the last (not necessarily the last by its number) lot available for bidding is concluded, its length is unknown. The recording of bids may depend on the computing devices used (notebook, tablet, mobile phone etc.), the internet service provider, the current data transfer speed, the type and version of the browser used and its settings. Due to the above, Axioart Kft. does not guarantee either the recording of the bid/bid agent initiated in the last 5 seconds or the extension of the expiration time set as a result! Please place your bid before the last 5 seconds, or use the bid agent function, which you can find more information about in the menu of the service provider, under the auction details. Pressing the bid button entails an obligation to pay!
4. The buyer offering the highest bid shall win the lot at the hammer price, except for protected lots when the Ministry of Construction and Transport’s Inspectorate of Cultural Goods or one of the national public collections has priority to purchase the lot at the hammer price.
5. The purchase price includes the hammer price and the 15% auction fee. The buyer shall pay the purchase price in a 14-day grace period. The buyer can only take possession of the item if the total purchase price has been paid. If not picked up by the grace period’s end, a storage fee will be charged, which is 20% of the hammer price. The Auction House reserves the right to consider the buyer’s bid null and void if the buyer fails to take over the item within one month.
6. No seller nor any third party on the seller’s behalf may bid in order to reach an unreasonably high price and thus inflict loss on any other party.
7. All the lots are exhibited for inspection during the online auction and please feel free to contact us if you need additional photos of the lots. The descriptions and illustrations in the catalogue are only for identification. Each bidder is responsible for inspecting the condition of the lots prior to the auction and deciding if it is in accordance with the description in the catalogue. All the lots are sold without a warranty with all the imperfections they may have at the time of the auction.
8. The items auctioned may not be sold under the starting price in the catalogue. The Auction House will not bear any liability regarding the bid or the purchase price paid and may not be compelled to reoffer the same item or market it at any time at the same price.
9. No protected item may be taken abroad (their numbers shall be made public by the beginning of the auction at the latest), and the Auction House will register their owners at the Ministry of Construction and Transport’s Inspectorate of Cultural Goods, according to the Act on the Protection of Cultural Goods (LXIV/2001). Owners are expected to report any intention to sell the protected item.
10. In case the buyer is not able or does not wish to register for the online auction, the buyer can place an absentee bid. Based on a given absentee bid, the Auction House will bid on behalf of the buyer. You may submit bids:
– personally – in our shop at 1052 Budapest, Vitkovics Mihály utca 12.
– by phone – +36 20 343 3282
– in written form – by post to H-1052 Budapest, Vitkovics Mihály utca 12. or via email at info@hereditasantikvarium.hu
11. Unsold items may not be reauctioned, but during the week following the auction, they can be purchased– with the same conditions – at the Auction House upon request.
12. The Civil Code (V/2013) shall govern any matter unregulated in the present Conditions of Sale. Should any dispute arise, the parties accept the competence of the district court, determined by the location of the Auction House.
